Question for the photography/legal buffs out there.

If Person A takes a photo of Person B. Can Person B enter that photo in an online competition (to win a holiday) without the express consent of Person A?

If it helps:

- The competition requires you to be in the photo, not just have taken it.
- The competition has asked if Person B has the copyright rights.
- Person A lives in another country.

The person taking the photo (person A) owns the copyright.

Does the competition require you to be in the photograph and also have taken the photograph?

Yeah that was the advice I gave. I basically said that you need Person A's permission to do anything with the photo, regardless of whether you're in it or not.

You didn't have to actually take the photo, no. I assume the more likely scenario is that you ask your friends permission to use a photo of you and they say 'sure thing'. Trouble with this one is that Person A and Person B haven't had any contact since the photo.

It's unlikely that Person A would ever actually follow up about it, but it's a situation you'd want to avoid if possible - using their photo to win a competition without permission.

Is comp about the skill of the photography itself or more about the subject and location. This may clarify the ethical concerns?
