Have Been Shafted

Postby shandybass on Tue 11/Oct/11 3:35pm

Just wondering, I just bought a bike from the vorb classifieds and it is not really rideable due to knackered forks and serious damage to the downtube. The question was asked if there was anything wrong with it, to which the reply was "it is all good, hardly been ridden". What are my rights on getting my money back.Cheers

2nd hand not much, but if you have documentated evidence they lied then you can use the courts I believe.
But have you contacted the seller?

Arse.

If you cannot get any joy out of going back to the seller and getting your money back then you should name and shame on here. Vorb has a long memory and generally if someone has knowingly sold borked stuff and wont give money back then the person will be given stick any time they post on here. Also sometimes people know the posters and will peer pressure them into doing the right thing.

I have done some good deals on here, and I have also bought a wheel I was not at all happy with. Wheel guy refunded money when I talked to him about it.

Gonna give the guy a chance to come to the party, if not, name and shame for sure.

If it's the sidekick, you might have a small chance, it's pretty deceptive wording if it is genuinely buggered but on other hand, you had the opportunity to ask clearer questions.

it's gonna be a hassle if he's not going to party with you

Call him first if no luck go straight to small claims court if you don't have any ugly mates where he lives.

You'll need detail on issues with bike from reputable source - get it done as soon as possible so it can't be argued you did it. Also note every bit of communication you have with him.

I wasnt able to check the bike because it was to far to travel so had it shipped. Seemed genuine enough though and it was 2010 frame. The frame was the main reason for purchase but the damage has me worried its gonna snap. Still waiting to hear back from the guy. Cheers for all advice.

Disputes tribunal - will hinge on being able to show he breached the contract (ie supplied goods not per the description and QnAs.

always try before you buy if you cant try don't buy...... I think you might struggle in a small claim against a private seller.... its a shame but true

If you’ve got the wording from the ad. tt shouldn’t be a problem. Sometimes when someone is threatened with disputes they usually pay up.
It worked for me in recent months. I actually did the claim etc and they paid up the day before the hearing :)

submit the case to the jurisdiction of the all knowing vorbii, you'll not see a penny in redress but there will be an hilarious thread full of barrack room lawyers pretending they have mad legal skills...
